Who we are

This website and our services are run by MOSEBY GLOBAL LLC (doing business as Moseby Studio). In these terms, "we" and "us" mean MOSEBY GLOBAL LLC, and "you" means anyone who visits this site, contacts us, or hires us. If you hire us for a business, "you" also means that business.

Using this site

You're welcome to read this site and send us an enquiry. Please don't copy its design, text, films or images for your own use, try to break or overload it, or use it to send spam or anything unlawful.

The garages, restaurants, shops and other businesses shown in our films and concept sites are fictional examples made to show our work. Prices on this site are starting prices. The price for your project is the one in your proposal.

What we do

We design, write and build websites for local and trade businesses, host and look after them on a monthly care plan, build brands, and run marketing such as local search, reviews, email, social posts and ads. Uniforms and merch are made through an affiliated company, under that company's own terms of sale.

Proposals and agreements

Before any paid work starts, we send you a written proposal. It describes what we'll make, what it costs, the schedule, how payment works and what happens if plans change. When you accept it, the proposal and these terms together are our agreement. If the two ever disagree, the proposal wins.

Work you ask for that isn't in the proposal is quoted separately before we do it.

Payment

You pay as your proposal sets out, which may be a deposit with the rest at milestones or at launch, or a payment plan on larger builds. Care plans and monthly marketing are billed each month in advance. Ad spend, domain fees and paid tools are passed through at cost or billed directly to you, and your proposal says which.

If a payment is late, we'll remind you first. If it stays unpaid, we may pause work until it's settled. Deposits pay for time already set aside for your project, and any refund is handled as your proposal describes.

Your part and approvals

A good site needs your input: details about your business, photos, logins and approvals. We'll ask for them clearly and keep to the schedule as long as they arrive on time. If they're delayed, the launch date moves with them.

You confirm that anything you give us (text, photos, logos, product details) is yours to use or that you have permission, and that what you ask us to publish is accurate and lawful. Nothing changes on your live site unless you asked for it or approved it.

Who owns what

Your domain is registered in your name, never ours. Once your project is paid for in full, you own the finished website, its content, and the brand files we hand over. Your accounts and data stay yours throughout, and you can have a full copy of your site whenever you ask.

We keep ownership of our own tools, code libraries, templates and methods that we use across clients. You get a permanent licence to use whatever of them is built into your site, for your business. Fonts, stock photos and plugins from other companies come with their own licences, which we arrange in your name or pass on to you.

We only show your work in our portfolio with your permission.

Care plans

A care plan covers hosting, backups, security updates and the small edits described on our Care page and in your proposal. Larger changes are quoted first. You can end a care plan as your proposal sets out. When you leave, we hand over a full copy of your site and help point your domain to its new host.

Marketing and results

We plan marketing with you each month, and nothing goes out without your approval. We report results in plain numbers such as calls, leads and bookings. Search rankings, ad performance and reviews depend on Google, other platforms and your customers, so we can't guarantee a particular ranking, number of leads or amount of revenue.

Text messages and email

The program. MOSEBY GLOBAL LLC (doing business as Moseby Studio) sends text messages about project updates, appointment and call scheduling, replies to inquiries, and occasional service offers to people who opt in through our website forms.

How you opt in. You opt in by checking the text message consent box on our project form and sending it with your mobile number. You must be 18 or older to opt in to text messages. Consent is not a condition of purchase.

How often. Message frequency varies. Message and data rates may apply.

How to stop. Reply STOP to opt out at any time. Reply HELP for help, or email hello@mosebystudio.com. After you reply STOP we send one message to confirm, and then no more unless you opt in again.

Carriers. Carriers are not liable for delayed or undelivered messages.

Your number. We do not share or sell mobile numbers or SMS opt-in data with third parties or affiliates for marketing or promotional purposes.

Emails about your enquiry or project are part of working together. Any marketing email we send carries a one-click unsubscribe.

Other companies' services

Your site may rely on services run by other companies, such as hosting, domain registrars, booking or ordering systems, payment processors, Google and social platforms. They have their own terms. We choose them carefully and set them up properly, but we aren't responsible for their outages, price changes or decisions.

What we stand behind

We do our work with care and skill, and we fix our own mistakes. Apart from that promise and what your proposal says, our services and this site are provided "as is", without other warranties, to the extent the law allows.

Limits on liability

To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost data or lost business, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that can't be limited by law.

Ending work together

Either of us can end a project or plan as the proposal sets out. You pay for work done up to that point, and we hand over what's been paid for. Sections that by their nature should continue, such as ownership, payment owed and limits on liability, stay in effect after the work ends.

Governing law

These terms are governed by the laws of the State of California. If a dispute comes up, we'll first try to sort it out by talking. If that doesn't work, it goes to the state or federal courts in Los Angeles County, California.

Changes to these terms

If we change these terms, we'll update this page and the date at the top. Changes don't affect a proposal you've already accepted unless we both agree in writing.
